Cheat sheet
- The State argues provisional evidence cannot be sought while a related case is already running, so the request is inadmissible.
- The State says the applicants share lawyers and a foundation with the main claimants and are trying to get around the law.
- The State argues the five people are not independent experts and their views are already public.
- The State says questions on US law, war crimes and the applicants' biological-weapon argument are legal questions for the judge, not experts.
- Bourla adds that Yeadon left Pfizer in 2011, never worked in vaccines, and made public claims Bourla calls false.
- Kant adopted the State's and Bourla's positions; Gates said he would neither support nor oppose the request.
Key passages · underlined
The persons named by the applicants cannot be regarded as experts, and certainly not as independent and impartial experts.
It therefore appears that the request by the applicants for provisional evidence is in fact intended to gather evidence for the ongoing proceedings of et al., and that this is an attempt to circumvent the statutory restriction of Article 196 paragraph 1 of the Code of Civil Procedure
Yeadon worked at Pfizer from 1995-2011. So he hasn't been employed by Pfizer for over 13 years. For that reason alone, it can't be that Yeadon was involved in the development of Comirnaty, which started in 2020.
Mr. Gates chooses to defer to the judgment of your court with regard to the application. He will therefore not file a statement of defense and we will not use any pleadings at the hearing.
Every defendant denies the claims, and the court has not ruled on them. Allegations are the claimants' pleaded positions, quoted as theirs. This is analysis and commentary, not legal advice. Interest of Justice is not a party to the case.
